Soldiers Have It Bad When It Comes To Alimony

Soldiers often do not even have the theoretical possibility that alimony to an ex-spouse will end should he or she remarry or obtain a position with a higher income. 1982 Uniformed Services Former Spouses Protection Act (USFSPA) provides states with the authority to treat non-disability military retirement pay as property which is a bad in itself but doubly outrageous because military retirement isn't like civilian retirement. In the military, retirement is not full retirement but switching to reserve status. You still have an obligation to serve the country.


Wow - The government can take the pension of someone who served the country for years and continues to do so in retirement and give it to an ex-spouse even if the ex-spouse remarries and makes far more money than the soldier. That is disgraceful.
